A accusation by proxy and the way to prove the delegation of authority



(1) 형사소송법 제236조의 대리인에 의한 고소의 경우, 대리권이 정당한 고소권자에 의하여 수여되었음이 실질적으로 증명되면 충분하고, 그 방식에 특별한 제한은 없다.

A complaint filed by proxy under Article 236 of the Criminal Procedure Act is validly filed if it is substantially proved that the authority to bring the charge was granted by the person entitled to file a complaint, and there are no special restrictions on how to prove such delegation of authority.


(2) 따라서, 고소를 할 때 반드시 위임장을 제출한다거나 '대리'라는 표시를 하여야 하는 것은 아니다.

Accordingly, a power of attorney is not required, nor is it required to specify in the complaint that it is being filed by proxy.


(3) 또 고소기간은 대리고소인이 아니라 정당한 고소권자를 기준으로 고소권자가 범인을 알게 된 날부터 기산한다.

Furthermore, the statute of limitations begins to run from the date on which the person entitled to file a complaint becomes aware of the identity of the alleged offender, based on the knowledge of the lawful person entitled to file the complaint, and not the knowledge of the agent who filed the complaint.

형사판결문에 판사의 날인이 없으면, 형사소송법 제383조 제1호의 "판결에 영향을 미친 법률의 위반이 있는 때"에 해당한다는 이유로, 벌금 100만원의 항소심판결을 파기환송한 대법원 판결이 있었다. (대법원 2015. 7. 23. 선고 2014도17514 판결)


법관의 서명·날인이 재판서의 성립요건이므로, 서명·날인이 누락된 재판서는 재판서로서의 효력이 없다는 대법원판결은 전에도 몇 차례 있긴 했다.

판결문에 재판장의 서명날인이 없고 판결이유란에 “피고인의 범죄사실은 별첨 공소장 기재 범죄사실과 같다”는 기재만 있고 공소장이 첨부되어 있지 않은 관계로 판결문이 적법하게 성립된 것도 아니고 피고인에 대하여 특정의 범죄사실을 인정한 것이라 할 수도 없다.

판결문에 재판장의 서명날인은 없고 관여법관 2인의 서명날인만 되어 있는데, 서명날이 누락이유도 부기되어 있지 않다면, "판결에 영향을 미친 법률위반"으로서 파기사유가 된다.


물론, 정확하게 절차를 지키는 것은 바람직하긴 한데, 관여법관이 실체적 심리를 마쳤음에도 실수로 판결문에 날인을 하지 않았다고 해서 파기환송하여 또다시 공판절차를 진행해야 한다는 것은 지나친 면이 있지 않나 싶다.

문자 그대로 '판결'에 영향을 미쳐야 법률 위반이라고 평가할 수 있을 것 같은데, 서명날인이 없다는 것이 실질적으로 판결에 영향을 미친 것인지 의문이다.

사법부가 대통령에게 휘둘리던 6~90년대에는 재판서에 법관의 서명날인이 있느냐 여부가 매우 의미있는 요건이라 평가할 수 있지만, 지금 시대가 그런 시대도 아니고, 환송심에 내려갔다가 다시 상고심으로 올라와야 하는 공판절차가 피고인에게 무슨 이익이 있나 싶다. 어차피 파기환송되어도 결국 재판장의 서명날인만 보강한 채로 똑같은 판결이 나올텐데, 과연 이런 절차의 반복이 합리적인 것인지 의문이다. 서명날인이 누락되었다는 이유로 파기환송된 것인데, 환송심에서 실체적 심리를 한다면 그것도 문제가 될 것이다. 결국 대법원의 파기환송이 피고인에게는 아무런 이익이 없는 것이 아닐까?

The decision to confiscate the guarantee amount and the decision to cancel the bail

 

 

1. 형사소송법 제103조 제1항은 "보석을 취소할 때에는 결정으로 보증금의 전부 또는 일부를 몰취할 수 있다."라고 규정한다.

Paragraph 1 of Article 103 of the Criminal Procedure Act provides that "at the time of the cancellation of the release on bail, the order can also confiscate part or all of the guarantee amount."

 

2. 이는 보석취소사유가 있어 보석취소결정을 할 경우에는 보석보증금의 전부 또는 일부를 몰수하는 것도 가능하다는 의미로 해석될 뿐, 문언상 보석보증금의 몰수는 반드시 보석취소와 동시에 결정하여야 한다는 취지라고 단정하기는 어렵다.

In case where the decision for cancellation of bail was imposed due to a justifiable reasons for cancellation of bail, this can be interpreted as a possibility of confiscation of part or all of bail guarantee amount, but according to the sentence above it is difficult to conclude that the confiscation of the guarantee amount for bailment should concurrently occur with cancellation of bailment.

 

3. 동법 제103조 제2항은 보석된 자가 유죄판결 확정 후의 집행을 위한 소환에 불응하거나 도망한 경우 보증금을 몰수하도록 규정하고 있어 보석보증금은 형벌의 집행 단계에서의 신체 확보까지 담보하고 있으므로, 보석보증금의 기능은 유죄의 판결이 확정될 때까지의 신체 확보도 담보하는 취지이다.

Since paragraph 2 of Article 103 of the same Act provides that in case of when a party who has not replied to a summons to return for an execution of decision of guilt, or fled, the guarantee amount can be confiscated, the guarantee amount for bail guarantees the securing of the body during the trial procedure leading to the execution of the penalty.

 

4. 보석취소결정은 그 성질상 신속을 요하는 경우가 대부분임에 반하여, 보증금몰수결정에 있어서는 그 몰수의 요부(보석조건위반 등 귀책사유의 유무) 및 몰수 금액의 범위 등에 관하여 신중히 검토하여야 할 필요성도 있다.

Considering the function of the guarantee amount for bailment should be seen as a collateral to secure a body during an enforcement of a criminal penalty process, and there is need to carefully exam the extent of the confiscation amount and the principality of the confiscation (existence of either violation for the condition of bailment or attributable reasons) while the decision to cancel the bail mostly requires quickness.

 

5. 따라서, 보석보증금을 몰수하려면 반드시 보석취소와 동시에 해야만 가능한 것이 아니라 보석취소 후에 별도로 보증금몰수결정을 할 수도 있다.

Thus, it does not have to be enforced with cancellation of bail at the same time, but the decision to confiscate the guarantee amount can occur separately after the cancellation of the bail.

 

6. 그리고 형사소송법 제104조가 구속 또는 보석을 취소하거나 구속영장의 효력이 소멸된 때에는 몰수하지 아니한 보증금을 청구한 날로부터 7일 이내에 환부하도록 규정되어 있다고 해도, 이 규정의 해석상 보석취소 후에 보증금몰수를 하는 것이 불가능하게 되는 것도 아니다. 

And even though Article 104 of Criminal Procedure Act provides that the guarantee amount that has not been confiscated, when effect of writ of confinement is expired or when the bail is cancelled or the party is arrested, should be restored 7 days after the date the request has been filed for the guarantee amount, the interpretation of this article does not make it impossible to confiscate the guarantee amount after the cancellation of bailment.

Supreme Court Decision 99Do5350 delivered on February 25, 2000

 

 

1. Summing-up

 

(1) The summary of the indictment

 

ⓐ In the past the defendant has often engaged in domestic arguments with the victim, her husband.

ⓑ Around 01:20 on the date of March 12, 1999 in the inner room of the Galbi restaurant operated in their residence, the defendant, while once again engaging in a domestic argument with the victim, in a rage decided to murder the victim, seized the knife on the cutting board by the door, and stabbed the victim's left chest once, causing the victim to die on the spot from a piercing of the heart. The death constitutes a murder.

 

(2) The claim of the defendant 

 

ⓐ The defendant has consistently denied the charges.

ⓑ In the past the victim had on many occasions picked up a knife while engaging in a domestic argument with the defendant. 

ⓒ And at the time of this incident, the victim picked up the knife on the cutting board by the door and faced the defendant when the defendant tried to leave the room at the conclusion of the argument.  

ⓓ While in this position, the victim held the knife in his right hand and the defendant's right shoulder in his left hand, and while pulling the defendant, walked backwards until colliding with the desk behind him.  

ⓔ At this point, the defendant told the victim to release her, pushed the victim's left hand away that was grabbing her right shoulder, and took the knife from the victim's hand.  

ⓕ As the victim did not use strength to hold onto the knife or resist and gave up the knife, the defendant received the knife and placed it again upon the cutting board on which it first lay. 

ⓖ At the moment when the defendant turned back around, the victim was clutching his chest and had fallen down by himself.  

ⓗ The defendant at no point stabbed the victim, and since at the time of taking the knife from the victim, the victim gave up the knife without a quarrel, it is not at this time that the victim was injured.  

ⓘ The defendant believes it probable that the victim was stabbed by the knife between the point in time when he, while holding her left shoulder and walking backwards, collided with the table and the point in time when the defendant pushed away the victim's left hand, which was holding her right shoulder.  

ⓙ However, as the defendant did not observe this, she claims not to know how the victim was stabbed by the knife.

 

2. The judgment of the court below

 

(1) The point of contention in this case is whether, through a quarrel while holding the knife and attempting to take it, by collision with other obstacles, or other reasons, the knife stab was accidental, or whether the defendant deliberately stabbed the victim with the knife. 

 

ⓐ The victim died from a piercing to the heart and it was not caused by an act of another person.

ⓑ At the time of the incident, the house was only occupied by the defendant and the victim who were spouses.

ⓒ The victim held the knife and threatened the defendant.

 The knife was held such that the blade faced the direction of the fourth finger and the butt of the handle faced the direction of the thumb.

ⓔ The deceased victim had a single piercing with an approximate length of 2.5cm and a depth of 15cm with the blade facing outward on the left breast, such that the wound not only appears from the outside to be virtually horizontal but also does not lean to either side and faces directly toward the back, and appears to have come out of the wound immediately with no movement within, and that the victim does not have any other injuries from self-defense or self-infliction.

ⓕ It is also declared that the victim did not commit suicide.

ⓖ The defendant testified that the victim had not committed suicide and there was no self-inflicted wound or motive for suicide.

ⓗ At the time of death, the victim wore a down vest, sweater, and t-shirt and all of these clothes were pierced at the same point and with the same shape as the heart injury. It does not appear that the victim stabbed himself, thus allowing the elimination of suicide as possibility.

ⓘ Since, if the victim had been holding the knife at shoulder level the blade would have faced downward, if the piercing had been inflicted on the victim accidentally during a fall from a collision with an obstacle, such as the desk while walking backwards, or while pushing the victim's left arm away and taking the knife, not only should the wound have indicated that the blade of the knife faces toward the center of the body, but also it is unlikely that the piercing would be horizontal.

ⓙ Therefore, the victim was not accidentally stabbed in the process of pushing away the victim's left hand, which was holding the defendant's right shoulder, and struggling while taking the knife or from falling after a collision with an outside object.

ⓚ In consideration of circumstances such as the position of the wound, the shape and direction of the blade in the wound, and the condition of the victim's body, it can only be concluded that the defendant stabbed the victim with the knife.

 

(2) The defendant's action of stabbing the victim's chest with a knife indicates an intent to kill.

 

3. Judgment of the Supreme Court

 

(1) Direct evidence corroborating the charge that the defendant murdered the victim by deliberately stabbing the latter with a knife

 

(A) The testimonies

ⓐ A portion of the reported testimony drawn up by the judicial police officer during suspect interrogation wherein the defendant confessed to part of the charges.

ⓑ A report of the judicial police officer that summarizes the defendant's reenactment of the crime during on-the-scene investigation.

ⓒ The testimony of 'A', 'B', 'C' to the prosecutors and to the court of first instance that "immediately after the accident at the hospital where the victim was brought in, the defendant was heard telling A 'I killed him,'" and B's testimony to the prosecutors that "when the defendant was first being questioned by the police, the defendant was heard responding to questioning by lowering her head and saying, 'I killed him.'"

 

(B) Judgement

ⓐ The defendant contests in court the testimony of B on the defendant's testimony to the police and on the defendant's confession to the crime at the investigation quarters, and the above report of the on-the-scene investigation and, therefore, these lack viability as evidence.

ⓑ Although the above account of the defendant's words to A at the hospital immediately after the incident was made in especially credible circumstances and can be said to have some viability as evidence even if the testimony is denied by the defendant, in light of the colloquial practice of Korean language, it is appropriate to interpret the statement "I killed him." as expressing remorse over guilt that through the defendant's error or moral fault, the victim perished, rather than a statement with legal bearing that acknowledges the intentional murder of the victim.

ⓒ Therefore, the above cannot be directly construed as a confession by the defendant and ultimately there is no direct evidence to corroborate the charges.

 

(2) Criteria of finding defendant guilty, where no direct evidence

 

(A) The principle of criminal procedure

It is the principle of criminal procedure that in the case no testimony of witnesses and no other form of direct evidence exists and the indicted offense is inferred or deduced from indirect facts supported by lawful evidences beyond a reasonable doubt, defendant can be found guilty.

ⓑ The charges in this case can be upheld only if the possibility of suicide by the victim and the possibility of the victim's death as a result of an accident are eliminated beyond reasonable doubts and it could be inferred that the victim's death was caused by the action of the defendant stabbing the victim. 

 

(B) Indirect facts

 The part of the court below's judgment that eliminates the possibility of suicide by the victim can be fully approved.

 The defendant and the victim were facing one another when the victim threatened the defendant with the knife, while holding it such that the knife blade faced toward the fourth finger and the knife butt faced toward the thumb.

 The dead victim had a single piercing wound on his left breast with a length of 2.5cm and a depth of 15cm with the knife blade facing outward, with the wound nearly horizontally from the outside, straight toward the back without movement to either side.

ⓓ The knife fell out directly without movement within.

ⓓ The victim's body bore no other injuries from self-infliction or in self-defense.

 

(C) Judgment

The investigative report written by the head of the National Institute of Scientific Investigation and used as supporting evidence by the court below contain absolutely no content supporting the ruling.

ⓑ But the investigative report also used as supporting evidence in conjunction and written by Lee Yoon-sung of the Medical Law division of the Medical School at Seoul National University actually state, "The fatal piercing wound of the victim cut through only muscle and neither rib bone nor cartilage and would seem to have done so while offering little bodily resistance. The act of drawing out the knife would also seem to have required little in the way of strength, and the victim himself could have very well removed the knife himself after the wound was inflicted. Although the possibility of murder by another cannot be eliminated, it is not uncommon in reality for stabbing to occur in a situation of a quarrel, such as with the victim and defendant. If the defendant stabbed the victim with the knife while facing him, the direction of the piercing wound should have been downward, but the actual wound is nearly horizontal. Also, the victim was in standard health and, although the time period is short, could have acted even after the stab but did not have any injuries from self-defense while being attacked by the physically weaker defendant. In conclusion, there is a possibility that, as opposed to murder, this incident is a result of an unintentional accident that took place during the quarrel."

No other information seems to rule out the possibility of an unintentional accident, and thus the possibility that the death of the victim in this incident is the result of an unintentional accident rather than the defendant's intentional act of murder can be said to exist definitively.

ⓓ Therefore, as long as this possibility is not eliminated beyond reasonable doubts, it is clear that the charge that the defendant murdered the victim with a knife is not proved beyond reasonable doubts.

 

(3) Conclusion

 

ⓐ Despite the lack of supporting evidence necessary to eliminate reasonable doubts that the defendant murdered the victim with a knife, the court below ruled that by eliminating the possibilities of the victim's suicide or accidental death the defendant is guilty of the above charges.

ⓑ This is ultimately a misjudgment of the strength of evidence and steps over the line set by the Principle of Free Evaluation of Evidence.

ⓖ The judgment of the court below was rendered without sufficient evidence, which affected the conclusion of the judgment.

대법원 2013. 3.28. 선고 2012도13607 판결 【특정범죄가중처벌등에관한법률위반(절도)】판례공보 제417호

【사안】

 

1. 甲은 절도의 누범전과가 있는 자인데, 백화점 등 여러 매장에서 구두 1켤레(제1범행), 다른 구두 1켤레(제2범행), 여성복 1벌(제3범행)을 각 절취하였는데 제3범행시 매장에는 범인이 벗어 놓고 간 점퍼가 있었고 그 안에 신용카드매출전표가 있었다.

2. 경찰은 카드회사에 공문을 발송하여 매출전표 거래명의자를 밝혀내었고 이를 기초로 甲을 긴급체포하면서 신발장에서 제2범행으로 인한 구두 1켤레를 발견하여 추궁하자 피의자신문시 제2, 3범행을 각 자백하였다. 한편 피해자들은 범행을 당한 날부터 3개월 내지 1년정도 지난 시점에 자발적으로 피해사실을 임의 진술하였다. 
3. 이후 수사기관은 甲에 대한 구속영장를 청구하였으나 기각되어 甲은 석방되었다.

4. 甲은 5일 후 다시 경찰서에 출석하여 제1범행을 자백하면서 구두 1켤레를 임의제출하였다. 경찰은 제1, 2범행의 피해자를 불러 피해진술서를 제출받았다. 甲은 위법수사일부터 약 3개월후 공개된 제1심법정에서 임의로 공소사실 일체를 다시 자백했다.

5. 원심은 파생증거들에 대한 증거능력 여부에 관하여 별다른 심리 없이 증거능력을 인정하여 유죄판결을 선고하였다.

6. 甲은 공판절차에서 위법수집증거에 기초하여 얻은 파생증거의 증거능력은 부정되어야 한다고 주장하면 상고하였다.

Ⅱ. 위법수집증거의 증거능력

 

적법한 절차에 따르지 아니하고 수집한 증거는 유죄의 증거로 삼을 수 없다(형사소송법 제308조의 2).

그러나 위법수집증거라 할지라도 수사기관의 절차 위반행위가 적법절차의 실질적 내용을 침해하는 경우에 해당하지 아니하고, 오히려 그 증거의 증거능력을 배제하는 것이 적법절차의 원칙과 실체적 진실 규명의 조화를 도모하고 이를 통하여 형사사법의 정의를 실현하려 한 취지에 반하는 결과를 초래하는 것으로 평가되는 예외적인 경우라면 법원은 그 증거를 유죄인정의 증거로 사용할 수 있다(2007도3061).

 


Ⅲ. 독수독과이론과 예외이론

 

1. 독수독과이론의 의의

 

독수독과이론이란 위법하게 수집된 제1차 증거에 의해 발견된 제2차 증거의 증거능력을 배제하는 이론을 말한다.

 

2. 독수독과의 예외이론

 

(1) 선의이론

 

수사기관이 의도적으로 위법을 저질러 증거를 확보한 것이 아니라면 증거의 증거능력을 인정해야 한다.

 

(2) 불가피한 발견이론

 

위법수사에 의한 오염된 제1차적 증거가 없었더라도 파생증거가 다른 경로를 통해 불가피하게 발견되었을 것으로 증명할 수 있는 경우에는 인과관계가 단절되는 것으로 보아야 한다.

 

(3) 희석이론

 

피고인이 자유의사에 의해 행한 행위는 위법증거와 인과관계가 단절되기 때문에 제1차적 증거의 오염성이 희석되어 파생증거에 영향을 미치지 않는다.

 

(4) 독립된 증거원이론

 

위법수사가 있었더라도 이와 관계가 없는 독립된 근원에 의하여 수집될 수 있었던 증거임이 증명될 수 있을 경우에는 인과관계가 단절된 것으로 보아야 한다.

 

3. 독수독과이론의 예외에 관한 판례법리

 

독수독과이론의 예외인정 여부를 위하여 절차조항의 취지 및 위반의 내용과 정도, 구체적 위반 경위와 회피가능성, 절차조항이 보호하고자 하는 권리 또는 법익의 성질과 침해 정도, 수사기관의 인식과 의도, 파생증거 수집과정에서 발생한 모든 사정을 고려하여 주로 인과관계의 희석 또는 단절여부를 중심으로 전체적·종합적으로 고려해야 한다(2008도1143).

 


Ⅳ. 사안의 검토

 

1. 금융거래정보의 위법수집증거성 여부

 

수사기관이 범죄 수사를 목적으로 ‘신용카드물품거래정보’를 획득하고자 하거나 금융회사 등에 거래정보를 요구하기 위해서는 법관이 발부한 영장이 필요하다.
따라서 수사기관이 영장없이 매출전표의 거래명의자에 관한 정보를 획득하였다면, 그와 같이 수집된 증거는 원칙적으로 형사소송법 제308조의 2에서 정하는 ‘적법한 절차에 따르지 아니하고 수집한 증거’에 해당하여 유죄의 증거로 삼을 수 없다.

 

2. 독수독과이론의 예외이론 적용 여부

 

위법수집증거에 터잡아 수집한 파생증거들, 즉 甲의 자백, 피해자의 피해진술 등은 원칙적으로 증거능력이 부정된다. 다만 독수독과 예외이론에 따라서 증거능력 유무를 추가검토하여야 한다.

 

(1) 희석이론에 의할 경우

 

甲에 대한 구속영장 기각으로 석방된 후에 제3범행을 자백하였고 위법수사일부터 약 3개월이 지난 시점에 공개된 제1심법정에서 임의로 공소사실 일체를 다시 자백했으므로 희석이론에 따르면 유죄인정의 증거로 사용할 수 있는 경우에 해당한다.

 

(2) 선의이론에 의할 경우

 

제1, 2범행에 대한 각 피해 진술서는 수사기관이 피고인의 인적사항을 파악하기 위해 의도적으로 금융실명제를 회피하려고 한 것으로 보기는 어렵다는 점, 피해자들은 범행을 당한 날부터 3개월 내지 1년정도 지난 시점에 자발적으로 피해사실을 임의진술한 점, 甲이 임의자백을 한 후에 수집된 증거인 점 등을 고려하면 독수독과의 예외를 인정할 수 있다.

 

3. 결론

 

위법수집증거에 기하여 파생한 증거에 대하여 증거능력에 관하여 심리하지 않은 원심의 조치는 적절하지 않지만, 독수독과의 예외이론에 따라 유죄를 인정할 수 있으므로 원심의 판단은 그 결론에 있어 정하다. 따라서 甲의 주장은 타당하지 않다.
