The principle of the prohibition of disadvantageous alteration



(1) 불이익변경금지의 원칙은 피고인만이 또는 피고인을 위하여 상소한 상급심 또는 정식재판청구사건에서 법원은 피고인이 같은 범죄사실에 대하여 이미 선고 또는 고지 받은 형보다 중한 형을 선고하지 못한다는 원칙으로서, 이는 피고인의 상소권 또는 약식명령에 대한 정식재판청구권을 보장하려는 취지이다.

The principle of prohibition of disadvantageous alteration is that the appellate court should not render severer punishment than punishment imposed or noticed previously for the same criminal fact at higher court or formal procedure in lieu of a summary order filed by the defendant or for the defendant in order to guarantee the defendant's right of appeal or a right of demanding formal trial in lieu of a summary order.


(2) 선고된 형이 피고인에게 불이익하게 변경되었는지에 관한 판단은 형법상 형의 경중을 일응의 기준으로 하되, 병과형이나 부가형, 집행유예, 미결구금일수의 통산, 노역장 유치기간 등 주문 전체를 고려하여 피고인에게 실질적으로 불이익한가의 여부에 의하여 판단한다.

The severity of punishment under the criminal law should be a criterion for disadvantageous alteration and it should be determined based on whether the defendant is placed practically in a more disadvantageous position, considering the sentence in its entirety as to concurrent punishment, additional punishment, probation, total number of days of pre-trial detention, and detention in a work house, etc.
